Terms of Service

These Terms of Service ("Terms") govern your use of SpeakEasy's applications, services, and infrastructure (collectively, the "Service"). By using the Service, you agree to these Terms.

Acceptance

You must be at least 13 years old to use SpeakEasy. If you are using SpeakEasy on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

Accounts

You are responsible for maintaining the security of your account credentials. We recommend using a strong, unique password and enabling any available second-factor authentication. You are responsible for all activity under your account.

Acceptable use

SpeakEasy is designed for private, lawful communication. You agree to use the Service in compliance with all applicable laws and regulations in your jurisdiction.

Permitted uses include:

  • Personal private communication with family, friends, and colleagues
  • Professional communication, including legally sensitive communications with attorneys, medical professionals, and journalists
  • Operating a Community Server for your community under the Community Server tier

Prohibited uses

You may not use SpeakEasy to:

  • Illegal content: Distribute, transmit, or solicit content that violates applicable law, including but not limited to CSAM, which is strictly prohibited and will be reported to relevant authorities.
  • Harassment: Harass, threaten, or intimidate other users or third parties.
  • Spam: Send unsolicited bulk messages or automated spam.
  • Malware: Distribute malware, viruses, or other malicious code via the Service.
  • Service abuse: Attempt to gain unauthorized access to our systems, interfere with the Service, or conduct denial-of-service attacks.
  • Impersonation: Impersonate another person or entity in a manner intended to deceive.
  • Sanctions violations: Use the Service in violation of applicable export controls or sanctions programs.

Encryption and law enforcement

SpeakEasy uses end-to-end encryption. We cannot access message content or call audio/video. If compelled by valid legal process to provide data, we can only provide connection metadata (IP addresses, timestamps) as described in the Privacy Policy.

Service availability

We provide the Service on an "as is" and "as available" basis. We do not guarantee uninterrupted availability. We reserve the right to modify, suspend, or discontinue the Service with reasonable notice where possible.

Intellectual property

The SpeakEasy name, logo, and app design are our intellectual property. The cryptographic library is source-available under BUSL-1.1 (see the License page). You may not use our trademarks without permission.

Termination

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation. You may terminate your account at any time from the app settings.

Limitation of liability

To the maximum extent permitted by law, SpeakEasy's liability for any claim arising from use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Governing law

These Terms are governed by the laws of the jurisdiction in which SpeakEasy is incorporated, without regard to conflict of law principles.

Changes to these Terms

We may update these Terms. Material changes will be communicated via email or in-app notification with at least 30 days notice. Continued use of the Service after changes take effect constitutes acceptance.
